1. Introduction
Welcome to Fakiir, a Google Sheets extension combined with a Google Cloud-based API backend for data generation and license management, developed by Northgate Solutions. This document outlines the terms and conditions under which you may use the Fakiir services (hereinafter “Service”). By using or accessing the Service, you agree to comply with and be bound by these Terms of Service.
2. Eligibility and Account Use
License Subscription
Fakiir offers two types of license subscriptions:
- Personal, Single-Seat License: Intended for individual users who use the Service for non-commercial activities.
- Commercial, Single-Seat License: Intended for professional or business-related purposes by individual users.
Licenses, once activated, are permanently associated with the activating Google account. Purchases and management of licenses are conducted through Gumroad. Terminating or removing the Fakiir extension does not affect the associated licenses or payment obligations. Users’ rights related to Gumroad services can be reviewed in the Terms of Service of Gumroad, Inc.
Northgate Solutions reserves the right to refuse service to any user. However, there are currently no eligibility restrictions for using the Service.
3. User Responsibilities
You are responsible for maintaining the security of your Google account. You agree to notify Northgate Solutions if you suspect any security breaches related to the use of Fakiir.
You agree not to employ the capabilities of Fakiir for illegal or unethical activities. You also commit to reasonable use of the Service concerning both the volume of generated data and the frequency of usage.
4. License and Intellectual Property
All intellectual property rights for Fakiir are owned by Northgate Solutions. All third-party names and trademarks mentioned are the property of their respective owners:
- “Google Sheets,” “Google Workspace,” and “Google Cloud” are trademarks of Google LLC.
- “Gumroad” is a trademark of Gumroad, Inc.
- Fakiir incorporates the Python Faker module, utilized under the MIT License.
5. Payment and Refunds
License purchases, pricing plans, and billing practices are governed by the Terms of Service and agreements outlined by Gumroad, Inc.
6. Data Protection and Privacy
Fakiir operates in compliance with its Privacy Policy.
7. Limitation of Liability
Fakiir is provided “as-is,” with no implied warranties or guarantees. Northgate Solutions disclaims all liability for any potential service disruption resulting from the use of Fakiir. Any similarities between generated data and real individuals are purely coincidental.
8. Termination of Services
Northgate Solutions reserves the right to terminate a user’s subscription and license if:
- There is evidence of Service abuse or misuse.
- There is a breach of personal versus commercial license definitions.
- There is a breach of the single-seat license clause (i.e., attempting to use the license with multiple Google accounts).
Users may terminate their account by ending their license subscription via Gumroad and uninstalling the Fakiir extension from Google Workspace.
9. Modification of Terms
Northgate Solutions reserves the right to amend these Terms with a two-month notice. Revisions will be made available here. Users should review the Terms of Service bi-monthly to stay informed of any changes.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Berlin, Germany. Any disputes arising shall be resolved under the exclusive jurisdiction of the courts located in Berlin, Germany.
11. Miscellaneous
Nothing in these Terms shall limit your statutory rights as a consumer. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms represent the entire agreement between you and Northgate Solutions concerning your use of the Service.
